COUNCIL PROCEEDINGS
February 22, 2016

The Oelwein City Council met in regular session Monday, February 22, 2016. Mayor Sherrets called the meeting to order at 6:00 P.M.

Adopt Agenda A motion was made by M. Weber, seconded by Milks to adopt the agenda as presented. All voted aye.

Jessie Scheckel Jessie Scheckel, 710 3rd Avenue SW reported having six different renters at a neighboring home 706 3rd Avenue SW with multiple police visits is not safe for him family. Letzring will contact Police Chief Logan to review investigations and contact Mr. Scheckel.

Consent Agenda A motion was made by Stickel, seconded by Cantrell to approve the following consent agenda items:
1. Approval of the minutes of the February 8, 2016 regular meeting.
2. Claims Resolution in the amount of $329,963.04.
3. Class ‘C’ Liquor, Outdoor and Sunday Sales renewal for Clete and Connies.
4. Request from Oelwein Celebrations Renewed, Inc. to close portions of Frederick Avenue for annual celebration parade on June 4, 2016 and use of barricades and park.
5. Pay Request No. 1 to SW Bridge Engineers in the amount of $15,643.30 for work completed on Viaduct Project.
All voted aye.

Public Safety A motion was made by M. Weber, seconded by Cantrell to approve Public Safety Committee recommendation with traffic entering the drive-thru from Frederick heading west, exiting into the alley. All voted aye.

A stop sign will need to be added on the west side of the drive-thru lanes as well as a one-way sign for oncoming eastbound traffic.

Water Rates A motion was made by M. Weber, seconded by Milks to approve the first reading of an Ordinance Amending Water Rates, Chapter 7 of the Code of Ordinances of the City of Oelwein, Iowa

Sewer Rates A motion was made by B. Weber, seconded by Stickel to approve the first reading of an Ordinance Amending Sanitary Sewerage Rates, Chapter 7 of the Code of Ordinances of the City of Oelwein, Iowa.

Fox Engrs A motion was made by Milks, seconded by Cantrell authorizing signatures
East Penn Task Order on Fox Engineering Task Order for East Penn Utility Improvements in the amount of $118,000. All voted aye.

WWTP Pump A motion was made by Milks, seconded by B. Weber authorizing repairs
Repairs by Iowa Pump Works to Wastewater Treatment Lift Station in the amount of $13,050.83. All voted aye.

Resolution #4876 A motion was made by M. Weber, seconded by Stickel to adopt Resolution No. 4876 to Set Public Hearing on Proposed Conveyance of Outlot A, Industrial Park Third Addition, Oelwein, Fayette County, Iowa to Oelwein Chamber and Area Development, Inc. in Exchange for Parcel M in the East Half of the Southwest Quarter of Section 27, Township 91 North, Range 9 West of the 5th P.M., City of Oelwein, Fayette County, Iowa for 6:00 P.M. on March 14, 2016.

RFP City Attorney Five Requests for Proposals for City Attorney were received. Council chose three firms to interview. Sherrets suggested Dillon Law P.C. and Shannon Michael. B. Weber suggested Carter Stevens as well.

Letzring stated having an Attorney on retainer for questions that pop up is very important. Since the City has a new City Administrator, the attorney should be present at all council meetings.

Council is to submit interview questions to Letzring.

Park & Rec Mtg. Cantrell presented the February Park and Recreation Commission meeting minutes. A lengthy discussion on Park concessions took place.

Park & Rec recruitment for seasonal positions has started.

Burkhart is interested in installing the playground equipment that was removed from the Aquatic Center to the Sports Complex north of the shelter.

Appointments/ A motion was made by B. Weber, seconded by Cantrell to approve the
Reappointments reappointment of Kevin Minton to the Electrical Board; Brian Irvine to the Mechanical Board; Dan Stasi to the Park and Recreation Commission; Randy Irvine to the Plumbing Board; Tom Fick to the Tree Board; Marilyn Dahl to the Zoning Board of Adjustment and the appointment of LouAnn Milks to the UERPC Housing Commission; and Roger Boleyn to the Planning and Zoning Commission. All voted aye.

Energy Savings Oelweins goal to decrease city government energy use of 8% in government buildings and operation from 2013 to 2015 has been met. Further savings will also be recognized.

Letzring presented a report on city government energy use comparisons from 2013, 2014 and 2015. The Street Department will be replacing 105 light bulbs downtown which will decrease their lighting cost by approximately 33%.

Fire Department will also be replacing the incandescent bulbs to LED bulbs for a 73% savings.

Viaduct Project A prebid meeting for the viaduct is scheduled at 11:00 Tuesday, February 23 at City Hall.

Thyron Matthews Thyron Matthews, 117 3rd Avenue NE informed Council he was interested in providing concessions from his food trailer at Wings Park ball games. City Attorney VanVeldhuizen and City Administrator Letzring will meet with Matthews to discuss his options.

Consent Agenda A motion was made by Stickel, seconded by Cantrell to approve the following consent agenda items:
1. Approval of the minutes of the January 25, 2016 regular meeting.
2. Request from OCAD to close the 10 block of West Charles on Selected Thursdays from 5:00 – 8:00 P.M. for Party in the Park.
3. Request from Pony Express Riders of Iowa to collect funds at the intersection of Frederick and Charles March 25, 2016 from 8:30 A.M. to 11:30 A.M.

Jesse Dinsdale Jesse Dinsdale, Industrial Tech Instructor at Oelwein High School stated he is interested in the lot for the Building Trades class in which each student will receive 8.5 college credits from NICC.

Resolution #4874 Resolution No. 4874 Directing the Sale of the City’s Interest in Lot 2, Vine Addition to Oelwein, Fayette County, Iowa to Oelwein Community School.

VanVeldhuizen asked if anyone here came to raise their bid. No comments were made.

Viaduct Plans & Specs Letzring stated once plans and specs are approved for the viaduct it will be advertised for two weeks, have a pre-bid meeting, then two more weeks of advertising followed by bid opening on March 8, 2016.

A motion was made by Stickel, seconded by M. Weber to approve Plans and Specs from SW Bridge Engineering for Viaduct Improvement Project. All voted aye.

Geo Thermal Unit A motion was made by Milks, seconded by M. Weber to authorize
WWTP purchase of Geo Thermal unit from Ken’s Electric in the amount of $37,680 for wastewater treatment plant. All voted aye.

Boards and Sherrets shared a handout listing the expired or soon to expire Boards
Commissions and Commission appointments for council to review.

City Hall Renovation Mark Moine, Martin Gardner Architecture, Marion Iowa shared the renovation plan, cost and drawings with city council. Letzring included copies of several e-mails responding to questions. Moine stated the first step is to identify where the asbestos is, then bid for asbestos abatement. It would take approximately two weeks to abate the entire building causing City Hall business to temporarily relocate. An option that may cost more is to do half the building and relocate into the other half of the building. Once the testing results are returned, an abatement plan and costs can be prepared more accurately.

Work Session A work session will be scheduled February 22, 2016 following regular council meeting with Martin Garnder Architects to discuss further.

Lions Club Sherrets stated she was approached by the Lions Club for a community project. They would like to set up community gardens on unused city lots.

City Attorney City Attorney VanVeldhuizen stated his last day as Oelweins City Attorney is March 1. The city has received several responses to the RFP’s for City Attorney and interview questions are being prepared.

Letzring presented her Administrative report to council. Steve Kendall expressed interest in returning as acting City Administrator working 15-20 hours per week for approximately 30-60 days until the new City Administrator can start.

Stickel stated he had four calls from perspective attorneys that he referred to Letzring.

B. Weber reported on Fayette County Emergency Management. Their budget numbers are similar to last year.

The Public Hearing for the Fayette County Assessor to re-assess Fayette County residential properties is Thursday, February 18, 2016 at 5:15 P.M. at Fayette County Courthouse. It has been 25+ years this was last done. In 2021 the city will start receiving tax dollars based on the new taxable values.

Sherrets inquired what happens when there are no 911 numbers on buildings. The question was referred to the police and fire department.
