COUNCIL PROCEEDINGS
April 24, 2017

The Oelwein City Council met in regular session Monday, April 24, 2017. Mayor Sherrets called the meeting to order at 6:00 P.M.

Roll Call PRESENT: Milks, M. Weber, Cantrell, B. Weber, Christensen, Stickel
ABSENT: None
ALSO PRESENT: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by M. Weber, seconded by Stickel to adopt the Agenda as presented. All voted aye.

Lauren Allbriton Lauren Allbriton, Food Corps Service Member at Oelwein Schools introduced herself regarding the Oelwein Food & Fitness Club request to use City Park for a Fun Run.

Consent Agenda A motion was made by Milks, seconded by M. Weber to approve the following Consent Agenda Items:

a. Minutes of the April 10, 2017 regular Council Meeting
b. Claims Resolution in the amount of $669,648.83
c. Class ‘C’ Liquor, Outdoor and Sunday Sales renewal for Mona’s Firepit
d. Class ‘B’ and Sunday Sales renewal for Pizza Hut #4340
e. Request from Oelwein Wrestling Club for use of Sports Complex Soccer fields Saturday, June 24, 2017 for a Knockerball Tournament
f. Request from Oelwein Food & Fitness Club for use of City Park Saturday, May 27, 2017 for a Fun Run
g. Wastetreatment Plant Pump repairs in the amount of $7,240 from Cahoy

Public Hearing A motion was made by Stickel, seconded by Milks to open the
Public Hearing on the proposed disposal by sale of the city owned property located at 956 South Frederick, Oelwein, Fayette County, Iowa.

Motion Carried

Travis Bushaw, Oelwein Wrestling Club, Inc. informed Council the existing building at the old P & P would be torn down and a new 6,000 square foot facility built to hold wrestling practice, gymnastic classes, indoor batting cages and bow target practice.

No comments were received from the public.

A motion was made by Stickel, seconded by Milks to close the Public Hearing.

Resolution #4968 A motion was made by Cantrell, seconded by Milks to adopt Resolution No. 4968 Directing the Sale of the City’s Interest in 956 South Frederick, Oelwein, Fayette County, Iowa to Oelwein Wrestling Club, Inc.

Resolution #4969 A motion was made by M. Weber, seconded by Christensen to adopt Resolution
Accept Gearhart Grove No. 4969 Accepting and Approving the Plan and Plat Known as Gearhart Grove Addition to the City of Oelwein, Fayette County, Iowa.

Library Meeting Christensen presented the April Library Board minutes. Carroll Endicott was hired as the Children’s Librarian. Staff salaries will increase 3%. The attic insulation bid from B & B Construction for $6,385.68 was approved. Book and Bake Sale is scheduled for April 27-29.

Park & Rec Meeting Cantrell presented the April Park & Rec meeting minutes. Perry Comeau spoke about Friends of the Park development. There is still availability in the sponsorship program for disc golf signs and shelters. Tree Board met to discuss Emerald Ash Borer. Three infected trees were removed. City Park Campground was open for Easter weekend. K-6 soccer program started. Umpires are still needed for Little League. Discussion on hosting a 24 hour softball tournament at Wings Park took place. Aquatics Center is in need of an AED and a new backboard.

Airport Meeting Stickel presented the April Airport Board meeting minutes.

Rumor Has It Sherrets stated the “Rumor Has It” event at the Library was a full house. A second event is being scheduled for later this year.

Spring Cleanup Saturday, May 13 is Oelwein’s “Spring Clean Up” from 8:00 – 12:00 at the South Parking Lot.

Solid Waste Sherrets attended the April Solid Waste Management meeting. Fayette Co.
Management Mtg. Landfill will soon stop recycling plastic bags, possibly this summer.

NICC Class NICC is offering a Candidate class April 27 at 5:30 – 7:00 at the Wilder Center. Anyone interested in running for an elected office is invited to attend. RSVP to Kristina at 563-382-3990.

Civil Service A motion was made by Milks, seconded by Cantrell to approve the Mayor’s
Commission appointment of Tim Gilson to the Civil Service Commission. All voted aye.

Adjourn A motion was made by B. Weber, seconded by Milks to adjourn at 6:18 P.M. All voted aye.

The Oelwein City Council met in regular session Monday, April 10, 2017. Mayor Sherrets called the meeting to order at 6:00 P.M.

Roll Call PRESENT: Milks, M. Weber, Christensen, Stickel

ALSO PRESENT: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by M. Weber, seconded by Christensen to adopt the Agenda as presented. All voted aye.

Consent Agenda A motion was made by Stickel, seconded by M. Weber to approve the following Consent Agenda Items:

a. Minutes of the March 27, 2017 regular Council Meeting
b. Motion to approve IT services from Bergan KDV in the amount of $5,500
c. Class ‘C’ Beer, Class ‘B’ Wine and Sunday Sales renewal for Kmart #9233
d. New Class ‘B’ Beer and Outdoor Service for Oelwein Celebrations

Public Hearing A motion was made by Milks, seconded by M. Weber to open the
Public Hearing the proposed disposal by sale of city owned property located at 116 3rd Avenue NE and 608 South Frederick

Motion Carried

One offer was received for 116 3rd Avenue NE from adjoining property Michael Decher in the amount of $500. Plans are to expand his yard.

Three offers were received for 608 South Frederick:

Brian Batterson, not to exceed $1,500.00, adjoining property owner
Sacred Heart Parish, accept as gift for use as storage/green space
Randy Kaune, Jr, $6,000, use as storage.

City Administrator Mulfinger stated 116 3rd Avenue NE has one offer while 608 South Frederick has three offers. This is an NSP property so even if the offer contrains any monetary value, it’s not something we want to gain off it because we don’t want to re-open the program and send the money to the state.

City Attorney expressed concern regarding accessory use. He advised the city to not get in the business of having single lots with garages on them throughout the city in absence to adjoining to a neighboring parcel. He stated most cities don’t want to see a bunch of random garages owned by random people as a planning consideration.

Stickel inquired that the lot does not meet city code to be buildable.

Mulfinger informed council that a decision did not have to be made tonight.

Resolution #4963 A motion was made by Stickel, seconded by M. Weber to adopt Resolution 4963 Directing the Sale of the City’s Interest in 116 3rd Avenue NE and table the sale of 608 South Frederick, all in Oelwein, Fayette County, Iowa.

Resolution #4964 A motion was made by Stickel, seconded by Christensen to adopt Resolution
Gearhart Grove No. 4964 to Exempt Street Surfacing Requirements in Gearhart Grove
Street Surfacing Addition to Oelwein, Fayette County, Iowa.

Tim Gearhart, 505 7th Street SE presented council with signed copy of Covenants of subdivision.

Stickel inquired if Gearhart would hard surface the roads in the future and Gearhart responded yes.

Approve Plat A motion was made by Christensen, seconded by Milks to table a Resolution
Tabled Accepting and Approving the Plan and Plat Known as Gearhart Grove Addition to the City of Oelwein. All voted aye.

City Attorney advised council to table the above Resolution since the Covenants of Subdivision document was just received by council from Gearhart needs to be reviewed by him. The city has received verbal approval from County Sanitarian pending receipt of hard copy.

FY 2015-2016 Audit Paul Yokas, RFSW & Co. presented the 2015-2016 Audit to council.

1023 2nd Street SW David and Roxanne Lenz are requesting a 15 year variance preventing
Sanitary Sewer Hookup forced hookup to city sanitary sewer. The Lenz family wants to ensure that their septic system is protected and are not required to hook up shortly after installation. State code requires that any house within 200 feet of sanitary sewer must connect. The Lenz property is just outside this 200 ft sewer hookup requirement.

No action was taken due to lack of a motion.

Resolution #4965 A motion was made by M. Weber, seconded by Stickel to adopt Resolution
Ind Park 3rd Add No. 4965 authorizing Second Amendment to Owner’s Statement,
Alliant Substation Covenants and Restrictions for Industrial Park Third Addition, City of Oelwein, Fayette County, Iowa.

Resolution #4966 A motion was made by Stickel, seconded by M. Weber to adopt Resolution
Temp Closure No. 4966 Authorizing Temporary Closure of Public Ways or Grounds for 6th Annual Memorial Ride and Drive for the Girls.

Set Hrg – Urban No. 4967 Setting Date for Public Hearings on 2017 Amendment to Urban
Renewal Renewal Plan for Industrial Park Urban Renewal Area and 2017 Amendment to Urban Renewal Plan for Central Urban Renewal Area.

Sherrets assisted the Chamber to fill and deliver 530 Easter Baskets.

Spring Cleanup is Saturday May 13, 8:00 A.M. – 12:00 at the South Parking Lot. Contact City Hall for additional information. There will be no TV’s allowed.

City Park Campground will open April 15th.

The “Rumor Has It” event is scheduled for 6:00 P.M., April 12 at the Oelwein Public Library. This is an information Q & A for the public to collaborate with the Mayor, City Administrator and council.

Sherrets asked the city to have Street Superintendent follow up on her request for “Deaf Children” signed in an area of town.

Chief Logan updated council on the Landlord meeting March 15. 38 Landlords attended and shared landlord concerns regarding background checks on tenants and creating a general landlord/tenant rental agreement for all to use. Since building permits are now on line, Landlords will also register on-line all their rental property in Oelwein. The Oelwein Police Department wants to work with landlords to resolve code enforcement tenant issues.

Residential Tax Mulfinger spoke on behalf of the Oelwein Housing Committee tax abatement program. He presented four options for council to review the incentives. A work session will be scheduled on this topic.
