COUNCIL PROCEEDINGS
Regular Meeting
August 26, 2019

The Oelwein City Council met in regular session Monday, August 26, 2019 at
6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Cantrell, Derifield, Fisk, Christensen, Milks, Weber
Absent: None
Also Present: Mulfinger, Wedemeier, Dillon

Adopt Agenda A motion was made by Weber, seconded by Derifield to adopt the agenda as presented. All voted aye.
Motion Carried

Brett Devore Brett Devore, 7 9th Ave SE, addressed the council regarding the smell on the NW & SW section questioning if anything has been done regarding it and if the public was notified.

Steve Koch Steve Koch, 904 W Charles questioned council if the dumping has stopped and how it is being monitored. Koch stated he has smelled the odor since the last meeting. Koch stated it is a health concern and would like his questions answered.

Major Sherrets suggested to set up a meeting with Utility Superintendent Kane to have his questions answered.

Consent Agenda A motion was made by Christensen, seconded by Fisk to adopt the Consent Agenda as follows:

A. Motion approving August 12, 2019 regular council minutes.
B. Claims Resolution in the amount of $337,069.15.
C. Class ‘C’ Liquor License renewal for American Legion Ross Reid Post #9.
D. Change Order No. 1 from JB Holland in the amount of $6,272.00 for Grading Connector Taxiway to Runway 13 End.
E. Pay Request No. 2 from JB Holland in the amount of $22,778.15 for work completed on Grading Connector Taxiway to Runway 13 End.
F. Pay Request No. 2 from JB Holland in the amount of $48,217.25 for work completed on Paving Connector Taxiway to Runway 13 Endex3e.

Ayes: Cantrell, Derified, Fisk, Christensen, Milks, Weber
Nays: None

Speed Zones A motion was made by Fisk, seconded by Milks to adopt the second reading of
Second reading an Ordinance amending Section 22-70 to change speed zones on Eastline Road and 20th St SE.

Ayes: Cantrell, Derifield, Fisk, Christensen, Milks, Weber
Nays: None

Motion Carried

Rezone Industrial A motion was made by Christensen, seconded by Derifield to rezone Lot 1, Industrial Park 2nd Addition and Lot 2, Block 1, Industrial Park 1st Addition from I-1 to C-2 Commercial. All voted aye.

Motion Carried

East Side Trail Sealing A motion was made by Cantrell, seconded by Derifield to accept proposal from Kluesner Construction, Inc. in the amount of $10,062.00 for east side trail sealing. All voted aye.

Library Report Christensen reported the Oelwein Public Library will be hosting “Strolling with the Spirits” cemetery walk at Oakdale Cemetery on Friday, September 6, 2019 from 6:00 – 7:30 P.M.

Airport Report Derified reported the Airport board discussed the capital plan at the last meeting. Discussion was held regarding burning at the airport and advised the FBO to remind patrons that burning is not allowed.

Mayor Sherrets reported the youth fly event was successful this past weekend. Mulfinger stated they had 117 kids fly for free during the event.

Park & Rec report Cantrell reported a new park assistant has been hired. The dog park has opened, and members of the community would like to plant more trees in the area. Cantrell stated more free libraries have been installed.

Housing Committee Fisk stated he has volunteered to canvass the area that has been awarded the CDBG grant to inform the homeowners of the opportunity. The committee is working on a plan for city owned empty lots. Fisk reported the committee would like to see 3 bids for any demo applications.

Boards & Commissions Mayor Sherrets stated there are still several openings on Boards and Commissions and if anyone has anyone that would interested please let her know.

City Attorney report City Attorney Dillon reported receiving notice of 4 additional abandoned properties he is working on.

Dillon stated he is reviewing the vacant property list and mailing notices to those owners.

City Administrator City Administrator Mulfinger requested council set a date for the Wings East Addition meeting.

Council updates Fisk requested council and staff be more proactive in researching the situation regarding the issue with the smell on the NW and SW sections of the city.

Derifield stated he would like to see the recycling dumpsters removed from the city due to the consistent issue with garbage being dumped at the site. Christensen suggested moving the dumpsters to County property. Sherrets stated she would contact the county for any suggestions.

August 12, 2019

The Oelwein City Council met in regular session Monday, August 12, 2019 at
6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Derifield, Fisk, Christensen, Milks, Weber
Absent: Cantrell
Also Present: Mulfinger, Wedemeier, Dillon

Adopt Agenda A motion was made by Christensen, seconded by Derifield to adopt the agenda as presented. All voted aye.
Motion Carried

Ron Winter Ron Winter, 914 4th Ave NE stated he seeded a gravel driveway for grass but still parks a utility trailer on the parking spot. He stated he was issued a warning for parking on the grass and wanted direction on the correct procedure he should follow. City Attorney Dillon referred him to contact code enforcement and the officer who issued the ticket.

Ron Winter stated he owns the duplex at 315 E Charles. He suggested to council that he would be willing to work on a possible tear down of the property next door to provide parking.

Ron Winter stated some of his properties are not passing inspection due to bedrooms not meeting code but is being taxed by the county as a bedroom. City Attorney Dillon stated taxation is with the County Accessor and to speak with them.

Brett Devore Brett Devore, 7 9th Ave SE questioned the council on the following:
1. How much money has the city lost running the Wellness Center?
2. Where is the Fee Schedule posted?
3. What is the bid process for the seal coat & stripping jobs on the agenda?
4. Was not aware of the work session on August 5, 2019
5. What is the City’s long term goals and plan for the cities water, sewer & roads?

Steve Koch Steve Koch, 904 W Charles questioned council on the status from the work session on August 5, 2019. He stated the smell occurred again Friday night and is concerned. Mayor Sherrets stated there is a meeting scheduled for August 13th. City Administrator Mulfinger stated test results have came back with nothing hazardous and within regulations.

Consent Agenda A motion was made by Milks, seconded by Weber to adopt the Consent Agenda as follows:

A. Motion approving July 22, 2019 regular council minutes.
B. Class ‘B’ Beer Permit and Sunday Sales renewal for Country Cottage Café.
C. Class ‘B’ Wine Permit and Sunday Sales renewal for Buds ‘n Blossoms.
D. Class ‘C’ Liquor License and Sunday Sales renewal for First Garden
E. Class ‘E’ Liquor License and Sunday Sales renewal for Super Mart
F. Class ‘E’ Liquor License and Sunday Sales renewal for Oelwein Mart.

Fisk questioned the expiration dates for insurance on consent items E & F.

Speed Zones A motion was made by Fisk, seconded by Weber to adopt the first reading of an Ordinance amending Section 22-70 to change speed zones on Eastline Road and 20th St SE.

Ordinance 1175 A motion was made by Milks, seconded by Weber to adopt the third and final reading of an Ordinance amending Oelwein Municipal Code Sections 22-126 Snow Emergency Parking Ban; Section 14-93 Clearing Snow, Ice and Accumulations; and Section 23-28 Depositing Snow on City Streets and Sidewalks.

Ayes: Fisk, Christensen, Milks, Weber
Nays: Derifield
Motion Carried

Resolution 5107-2019 A motion was made by Milks, seconded by Weber to adopt Resolution 5107-
Snow and Ice Policy 2019 amending the snow and Ice Policy.

Discussion was held on some of the language in the resolution. Fisk suggested working with residents with no place to go with the accumulation of snow on properties. Derifield concerned with downtown parking and how many handicap parking spaces are available in the parking lots.

Nays: Derifield, Fisk

Resolution 5108-2019 A motion was made by Milks, seconded by Weber to adopt Resolution 5108-
Wellness Center Lease 2019 approving a shared use and occupancy lease agreement with the Oelwein School District for the Oelwein Wellness Center.

Fisk requested to review options for the operations of the Wellness Center.

Ayes: Derified, Christensen, Milks, Weber
Nays: Fisk

Resolution 5109-2019 A motion was made by Weber, seconded by Fisk to adopt Resolution 5109-2019
Fes Schedule amending the Fee Schedule leaving the appeal fee at $100.

Discussion was held regarding reducing the appeal fee to $50. Mayor Sherrets requested leaving the fee at $100.

Seal Coat Project A motion was made by Milks, seconded by Weber awarding bid to Blacktop Services Company, Humbolt for 2019 Seal Coat Improvements project in the amount of $169,047.78. All voted aye.

Road & Lot Painting A motion was made by Derifield, seconded by Milks approving Road and Lot
Painting with A-Line Stiping and Sweeping in the amount of $10,055.00 with the handicap parking spots painted blue. All voted aye.

Fill the Boot A motion was made by Fisk, seconded by Milks a request from the Oelwein Fire Department to collect funds for MDA “Fill the Boot” campaign at the intersection of 1st Avenue and Charles Street on Friday, August 23, 2019 from 6:00 P.M.-8:00 P.M. and Saturday, August 24, 2019 from 6:00 P.M. – 7:30 P.M. All voted aye.

Motion Carried

Cemetery Walk A motion was made by Milks, seconded by Fisk a request from the Oelwein Public Library to host “Strolling with the Spirits” cemetery walk at Oakdale Cemetery on Friday, September 6, 2019 from 6:00 – 7:30 P.M. All voted aye.

Motion Carried

Wastewater Meeting Fisk questioned who is attending the meeting on August 13, 2019. Mulfinger stated himself, wastewater staff and the company representative.

Executive Session A motion was made by Derifield, seconded by Weber at 6:56 p.m. to go into Executive Session per Iowa Code 21.5(1)(c) to discuss strategy with Counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the City in that litigation.

Return to Regular A motion was made by Milks, seconded by Fisk to return to regular sessions at 7:15 P.M. All voted aye.
