Regular Meeting
April 22, 2019

The Oelwein City Council met in regular session Monday, April 22, 2019 at
6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Milks, Weber, Cantrell, Derifield, Fisk, Christensen
Absent: None
Also Present: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Weber, seconded by Derifield to adopt the agenda as
presented. All voted aye.
Motion Carried

Arbor Day Mayor Sherrets presented an Arbor Day Proclamation to Joshua Johnson and his two daughters.

Brett DeVore Brett DeVore, 7 9th Avenue SE informed council garbage in the northeast had not been picked up. Mulfinger responded their truck broke down and they’ll be picking up into the evening.

Consent Agenda A motion was made by Weber, seconded by Fisk to adopt the Consent Agenda as follows:

A. Motion approving April 8, 2019 regular council minutes.
B. Claims Resolution in the amount of $412,922.29.
C. Class ‘B’ Beer and Sunday Sales Renewal for Pizza Hut #4340.
D. New Class ‘B’ Beer and Outdoor service License for Oelwein Celebrations.
E. Class ‘E’ Liquor and Sunday Sales renewal for Casey’s General Store #2682.
F. Pay Application #11 from Portzen Construction in the amount of $6,844.75 for work completed on Disinfection and 42 Well Improvements project.

All voted aye.

Key Boxes – 1st A motion was made by Fisk, seconded by Milks to adopt the first reading of an
Reading Ordinance Amending Chapter 5 of the Code of Ordinances of the City of Oelwein, Iowa by Adding Section 5-23 Key Boxes.

Nays: None

City Code, Ch. 12 A motion was made by Weber, seconded by Fisk to adopt the first reading of an
1st Reading Ordinance Amending Oelwein Municipal Code Chapter 12, Buildings, Article II Plumbing, Electrical and Mechanical Work.

Resolution 5084-2019 A motion was made by Milks, seconded by Cantrell to adopt Resolution No.
Close Street 5084-2019 Authorizing Temporary Closure of Public Ways or Grounds for Cars and Coffee.

Set Hrg, Alley Vacation 2019 to set Public Hearing on Proposed Vacation of the Alley Running East and West in Block 1, Smith Brothers First Addition to Oelwein, Fayette County, Iowa for May 13, 2019 at 6:00 P.M.

Resolution 5086-2019 A motion was made by Milks, seconded by Derifield to adopt Resolution No.
Set Hrg, Alley Sale 5086-2019 to set Public Hearing on Proposed Disposal by Sale of the City’s Interest in the Alley Running East and West in Block 1, Smith Brothers First Addition to Oelwein, Fayette County, Iowa for May 13, 2019 at 6:00 P.M.

Copier Purchase Three quotes were received for the City Hall copier.

Advanced Systems Xerox AL C8045 $11,395.00
Rite Price Kyocera 5053ci $9,287.00

A motion was made by Milks, seconded by Cantrell to authorize purchase of Kyocera 5053ci from Rite Price (Storey Kenworthy) in the amount of $9,287.00. All voted aye.

May Council Meeting A motion was made by Milks, seconded by Cantrell to reschedule the May
Dates 27, 2019 council meeting to Tuesday, May 28, 2019 due to Memorial Day Holiday. All voted aye.

Park and Rec Meeting Cantrell reported on the April Park and Recreation Commission meeting. Workers started hauling dirt for the dog park, then put up fencing. Gilson and Polark memorial benches were approved. Gearhart was voted Chairperson and Berryman Vice Chairman.

Housing Committee Fisk reported on the April Housing Committee meeting. Discussion regarding the code requirements on door locks on owner occupied property changes when that property becomes rental property. The committee met with Hub City Landlord Association.

Committee A motion was made by Cantrell, seconded by Milks to approve the following
Appointments appointments:

1. Reappointment of Ashland Taylor to Park and Recreation Commission
2. Appointment of Mike Kerns and Robert Lumbus to the International Code Council Board of Appeals
3. Appointment of Paul Ganske to the Zoning Board of Adjustment
4. Appointment of Deb Kellogg to the Community Plaza Board of Governors

All voted aye.

City Attorney Report City Attorney Dillon reported he is working with the Oelwein Railroad Museum to move the railroad car to the museum location.

City Administrator Boards and Commission packets are being created with information on job responsibilities and applications. A letter will be sent to the Plaza Foundation requesting they do their own appointments to the Board of Governors and change their by-laws accordingly. It is no longer necessary for the city to approve their appointments.
