The Oelwein City Council met in regular session Monday, May 13, 2019 at
6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Weber, Cantrell, Derifield, Fisk, Christensen, Milks
Absent: None
Also Present: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Weber, seconded by Cantrell to adopt the agenda as
presented. All voted aye.

Anthony Ricchio Anthony Ricchio, 522 West Charles Street shared the Grand Opening flyer for the Birdnow Soccer Complex taking place May 18, 2019 at 11:30 A.M.

Ginger O’Connell Ginger O’Connell, 303 3rd Street NE is in favor of remodeling the current City Hall old police department side, but leave off the front extension.

Brett DeVore Brett DeVore, 7 9th Avenue SE stated keeping City Hall remodel under $750,000 so it doesn’t go to a vote by citizens seems fishy. Funds should be used to improve roads, water mains and sewer lines. It is a want vs. a need.

LaVerne McLennan LaVerne McLennan, 119 12th Avenue SE stated she likes the building now and it’s not necessary to spend all that money.

Consent Agenda A motion was made by Milks, seconded by Fisk to adopt the Consent Agenda as follows:

A. Motion approving April 22, 2019 regular council minutes.
B. Class ‘C’ Liquor, Outdoor and Sunday Sales renewal for Leo’s Italian Restaurant
C. Class ‘C’ Liquor, Outdoor and Sunday Sales renewal for Mona’s Firepit Pub & Grill

All voted aye.

Public Hearing A motion was made by Weber, seconded by Derifield to open the Public Hearing on Proposed Vacation of the Alley Running East and West in Block 1, Smith Brothers First Addition to Oelwein, Fayette County, Iowa.

2nd Reading of an Ordinance Amending Chapter 5 of the Code of Ordinances of the City of Oelwein, Iowa by Adding Section 5-23 Key Boxes.

Code Ch. 12 A motion was made by Weber, seconded by Cantrell to adopt the second
2nd Reading reading of an Ordinance Amending Oelwein Municipal Code Chapter 12, Buildings, Article II Plumbing, Electrical and Mechanical Work.

Ch. 22-6 A motion was made by Derifield, seconded by Cantrell to adopt the first reading
1st Reading of an Ordinance Amending Section 22-6 to Modify Debris and Destruction or Injurious Material on Streets Prohibited.

Resolution 5087-2019 A motion was made by Fisk, seconded by Cantrell to adopt Resolution No. 5087-2019 Directing the Sale of the City’s Interest in the Vacated Alley Running North and South in Block 12 Between Lots 1-6 and 7-12 Armstrong’s Addition to Oelwein, Fayette County, Iowa.

Resolution 5088-2019 A motion was made by Milks, seconded by Weber to adopt Resolution 5088-2019 Setting Date for Public Hearing on Amendment to Series 2016A General Obligation Bond Issuance Resolution.

Refer to Planning and A motion was made by Cantrell, seconded by Fisk to forward to Planning and
Zoning Zoning Commission for recommendation a request to vacate and sell a portion of 5th Street NE as platted east of 8th Avenue NE. 5 voted aye, one (M. Weber) abstained.

Fisk stated what’s the difference selling prior alley at $0.20 per square foot vs. this at $1,500.00. Kane stated sewer lines would need easement for the city.

Refer Public Safety A motion was made by Fisk, seconded by Cantrell to forward a request
Stop Signs from Carol Miller, 820 3rd Avenue SW for stop signs at 8th Street SW and 3rd Avenue SW (east and west bound) to Public Safety Committee for recommendation. All voted aye.

P.H. FY 2018-19 A motion was made by Milks, seconded by Fisk to set a Public Hearing on Fiscal Year 2018-2019 Budget Amendment for 6:00 P.M. May 28, 2019. All voted aye.

Mower Purchase A motion was made by Fisk, seconded by Weber authorizing the purchase
Cemetery of a 60” mower from Burco Sales in the amount of $8,593 for Cemetery Department. All voted aye.

Reappointment A motion was made by Cantrell, seconded by Milks to approve the
Park & Rec Comm. Reappointment of Mike Meska and Tim Gearhart to the Park and Recreation Commission. All voted aye.

City Wide Cleanup Sherrets thanked council for help with city wide cleanup. Using two lanes sped up the 179 residents who took advantage of this and who also helped unloading items.

City Attorney Report Dillon stated he met with Code Enforcement and Police Department to discuss plan of action for code enforcement issues. He also worked on chronic nuisance research.

Airport Land Milks stated she received a call from Jerod Kane, land owner adjacent to Oelwein Airport that the airport land has broken field tile that is now running onto his land preventing him from getting his spring field work completed. City Attorney Dillon stated he is aware of this and is working on it.

3rd Avenue SW Milks and Cantrell stated they both received calls from citizens re: 3rd Avenue SW new No Parking signs. The width of the road does not allow for parking.

Into Executive A motion was made by Cantrell, seconded by Weber to go into Executive Session per Iowa Code Section 21.5(1)(i) to evaluate professional competency of individuals whose appointment, hiring, performance or discharge is being considered when necessary to prevent needless and irreparable injury to the individual’s reputation and at the request of said individual(s).

Annual Performance A motion was made by Cantrell, seconded by Derifield to table
Review review and discussion of City Administrator Dylan Mulfinger’s employee agreement until all reviews have been submitted. All voted aye.

Adjourn A motion was made by Cantrell, seconded by Weber to adjourn at 6:40 P.M. All voted aye.
