July 22, 2019

The Oelwein City Council met in regular session Monday, July 22, 2019 at
6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Cantrell, Derifield, Fisk, Christensen, Milks
Absent: Weber
Also Present: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Milks, seconded by Cantrell to adopt the agenda as
presented. All voted aye.
Motion Carried

Beth Eickhoff Beth Eickhoff, 601 2nd Avenue NE expressed her concern regarding a neighbors two dogs that keep escaping and running at large. Chief Logan stated they have been cited for running at large. Eickhoff is concerned a child is going to get hurt.

Consent Agenda A motion was made by Cantrell, seconded by Derifield to adopt the Consent Agenda as follows:

A. Motion approving July 8, 2019 regular council minutes.
B. Claims Resolution in the amount of $425,896.46.
C. Pay Request No. 13 from Portzen Construction in the amount of $43,969.08 for work completed on Disinfection and 42 Well Improvements.
D. Class ‘C’ Liquor and Sunday Sales renewal for Viper Lanes & PJ’s Bar and Grill.

All voted aye.
Motion Carried

Public Hearing A motion was made by Milks, seconded by Fisk to open the public hearing
2019 Seal Coat on the 2019 Seal Coat Improvements Project.

Third Reading The third reading of an Ordinance to vacate a portion of 5th Street NE
5th Street NE ROW Right-of-Way died for lack of a motion.

Second Reading A motion was made by Christensen, seconded by Fisk to adopt the second
Snow and Ice reading of an Ordinance Amending Oelwein Municipal Code Sections 22-126 Snow Emergency Parking Ban; Section 14-93 Clearing Snow, Ice and Accumulations; and Section 23-28 Depositing Snow on City Streets and Sidewalks.

Mulfinger presented all written comments.

Resolution 5105-2019 A motion was made by Milks, seconded by Cantrell to adopt Resolution
Temp Street Closure No. 5105-2019 Authorizing Closure of Public Ways or Grounds for Oelwein Fire Department.

Resolution 5106-2019 A motion was made by Milks, seconded by Cantrell to adopt Resolution
Temp Street Closure 5106-2019 Authorizing Closure of Public Ways or Grounds for Oelwein Community High School.

Dave’s Place Chief Logan stated Dave’s Place liquor license expired and was unable to
Liquor License produce a current license when asked by officers in July 2019.

A motion was made by Fisk, seconded by Derifield to request the Iowa Alcoholic Beverage Division not renew or suspend liquor license for 14 days. All voted aye.

Plan & Zone A motion was made by Cantrell, seconded by Milks to forward to Planning
Rezone I-1 Industrial and Zoning Commission for recommendation a request from Oelwein Chamber
To C-2 Commercial and Area Development to rezone Lot 1, Industrial Park 2nd Addition and Lot 2, Block 1, Industrial Park 1st Addition from I-1 Industrial to C-2 Commercial. All voted aye.

Planning, Finance, Cantrell reported on the 5:30 P.M. Planning, Finance, Enterprise and Economic
Enterprise and Development Committee meeting held prior to the council meeting. Three
Economic Devel. Applications for funding were received.

1. Oelwein Community Plaza Board requesting Hotel/Motel Tax Funds for Plaza Renovation in the amount of $7,800.00.
2. Bianca Trevino requesting demolition funds in the amount of $8,545.05 for the demolition of house and garage at 37 4th Avenue SE.
3. Steve Gabriel requesting demolition funds in the amount of $8,283.51 for the demolition of house and garage at 310 7th Avenue SW.

A motion was made by Fisk, seconded by Cantrell to approve Planning, Finance, Enterprise and Economic Development’s recommendation to fund Oelwein Community Plaza Board $7,800.00 (50/50 Hotel Motel Tax/Economic Development), Bianca Trevino 50% of $8,545.05 and Steve Gabriel 50% of $8,283.51 with the property owners having 60 days to complete the teardown and request funds. 4 voted aye, one (Christensen) voted nay.

Library Board Mtg. Christensen informed council the traveling exhibit on Alexander Hamilton arrived July 18. The Apple Seed Puppet Show was July 23 and 60 kids signed up for the Alien Making workshop. A Dr. Who escape room will be at the Library August 5-9.

Park & Rec Mtg. Cantrell reported on the July Park and Recreation Commission meeting. A drinking fountain will be installed at the dog park. The city received 55 trees from Trees Forever to plant in boulevards. There are also trees available to purchase at $200.00 each. Storms downed trees and broken limbs in the parks that had to be cleaned up. Rec started a new co-ed Flag Football program.

Housing Committee Fisk reported on the July Housing meeting. The City has $125,000 annually for the next three years and $480,000 in leftover bond proceeds to spend on housing improvements. The $480,000 may also be used for road, water and sewer infrastructure.

County Fair Judge Sherrets stated she is not able to attend Fayette Co. Fair as a BBQ judge and Fisk stated he could go in her place July 23.

City Attorney Dillon served five nuisance abatements and approximately 30 vacant houses did not register for inspection. He will send out one last letter on his legal letterhead encouraging people to register before applying their fee.

Sewer Odor Fisk stated he was asked to come to 609 West Charles Street regarding the sewer odor that has been appearing on and off since November 2018. Utility staff has been investigating this item.

Planning, Finance, Enterprise and Economic Development Committee met before the regular council meeting and a work session on City Council meeting procedures followed the regular meeting.
