COUNCIL PROCEEDINGS
June 9, 2014

The Oelwein City Council met in regular session Monday, June 9, 2014. Mayor Manus called the meeting to order at 6:00 P.M.

Roll Call PRESENT: Stickel, Petersen, Sherrets, Cantrell, Weber, Ryan
ABSENT: None
ALSO PRESENT: Letzring, Rigdon, VanVeldhuizen

Adopt Agenda A motion was made by Petersen, seconded by Weber to adopt the agenda as amended. All voted aye.
Motion Carried

Citizen Beth Eickhoff, 701 1st Avenue SE requested a curfew in Oelwein for children under age 18. She also raised a concern over a police matter which requires follow-up from an officer. Chief Logan will contact her.

Consent Agenda A motion was made by Weber, seconded by Cantrell to approve the following Consent Agenda items:
A. Minutes of the May 28, 2014 regular meeting.
All voted aye.

Public Hearing Manus opened the Public Hearing on the proposed vacation of the alley
Vacate Alley running North and South in Block 2 between Lots 1-6 and 7-12, Kint and Boyack’s Addition to Oelwein, Fayette County, Iowa. Sherrets asked for the street addresses of these properties.

No other comments were made.

A motion was made by Ryan, seconded by Petersen to close the hearing.

Suspend Rules A motion was made by Sherrets, seconded by Stickel to suspend the rules and adopt an ordinance on the first and final reading.

Ordinance #1130 A motion was made by Sherrets, seconded by Weber to adopt Ordinance
Vacate Alley No. 1130 Providing for the Vacation of that Portion of the Alley Running North and South in Block 2 Between Lots 1-6 and 7-12, Kint and Boyack’s addition to Oelwein, Fayette County, Iowa on the first and final reading.

Public Hearing Manus opened the Public Hearing on proposed disposal by sale of the City’s
Disposal by Sale interest in the alley running North and South in Block 2 between Lots 1-6 and 7-12, Kint and Boyack’s Addition to Oelwein, Fayette County, Iowa. No comments were received.

A motion was made by Petersen, seconded by Weber to close the hearing.

Resolution #4791 A motion was made by Weber, seconded by Cantrell to adopt Resolution #4791
Sale of Vacated Alley Directing the Sale of the City’s Interest in the Vacated Alley Running North and South in Block 2 Between Lots 1-6 and 7-12, Kint and Boyack’s Addition to Oelwein, Fayette County, Iowa.

Manus inquired about lowering the price per square foot. Weber asked to review for future but at this time to avoid a conflict of interest the price should stay the same as it has in the past. Attorney VanVeldhuizen stated vacated alleys are sold for $0.25 per square foot minimum.

Resolution #4792 A motion was made by Petersen, seconded by Stickel to adopt Resolution
NSP Amendment No. 4792 Authorizing Execution of Tenth Amendment to the Neighborhood
With IDED Stabilization Program Contract with the Iowa Department of Economic Development.

NSP A motion was made by Petersen, seconded by Weber to authorize signatures
MSA Professional on MSA Professional Services Agreement for NSP. All voted aye.
Services Motion Carried

Ordinance 1st Reading A motion was made by Stickel, seconded by Weber to adopt the first reading of an ordinance amending code re: RAGBRAI.

Letzring explained it is the same ordinance previously used when RAGBRAI came to Oelwein. These are Des Moines Register and Iowa State Highway Patrol recommendations.

Set Public Hearing A motion was made by Petersen, seconded by Stickel to set Public Hearing on Proposed Plans, Specifications, Form of Contract, and Estimate of Cost for June 23, 2014 at 6:00 P.M. for Rehabilitate Runway Lighting at the Oelwein Municipal Airport. All voted aye.

Resolution #4793 A motion was made by Weber, seconded by Cantrell to adopt Resolution
Kokomo Mortgage No 4793 Authorizing the Mayor to Execute Mortgage Release – Kokomo.

Resolution #4794 A motion was made by Petersen, seconded by Stickel to adopt Resolution
Set Public Hearing No. 4794 to Set Public Hearing on Proposed Disposal by Sale of the City’s Interest in 613 East Charles Street; 440 1st Avenue SE, and 517 8th Street SW; all in Oelwein, Fayette County, Iowa.
Ayes: Stickel, Petersen, Sherrets, Cantrell, Weber, Ryan

City Logo Utility Superintendent Vic Kane reported the West Water Tower needed to be painted and wanted to use a design that would look as nice as the East Water Tower. This developed discussion on creating a new City logo. This new logo would help re-brand the City for the future and further our progress toward positive change in Oelwein. The wording “The One and Only” supports we are the one and only “Oelwein”.

Weber suggested the City get public input regarding the new logo choices and if there should be a color change from green and yellow to something new. Council consensus is to continue to move forward on the new logo design and perhaps update the color choice as well.

Plaza Board Mtg. Ryan reported on the June Plaza Board meeting. Roof repair is complete. Parking lot has been striped. The air conditioning units will need to be replaced.

Appointments A motion was made by Ryan, seconded by Sherrets to approve Mayor Manus’s recommendation to table item A until the June 23rd meeting and to accept appointment/reappointments B, C, D and E.

A. Appointment of Elmer Pearson to the Civil Service Commission.
B. Reappointment of Lori Leo to the Library Board.
C. Appointment of Dan Stasi and Lynn Soll to the Park and Recreation Commission.
D. Reappointment of Jim Prouty to the Park and Recreation Commission.
E. Appointment of Savannah DeJong and Linda Benter to the Planning and Zoning Commission.

All voted aye.
Motion Carried

Manus would like to add another position to the Park and Recreation Commission. VanVeldhuizen stated Council could change the ordinance to expand the Commission number.

115 South Frederick 115 South Frederick demolition permit has been issued and the “Notice to Proceed” will be issued to have the building down in 30 days.

Viaduct Painting The West Charles viaduct will be closed 7:00 A.M. to Noon Friday, June 13th for painting. Vehicular and Pedestrian traffic will need to find an alternate route during this time.

Special Meeting A special council meeting was scheduled for Wednesday, June 11 at 6:00 P.M. to discuss viaduct repair grant application.

Mow Orders Manus would like to see fines increase on habitual offenders re: property owners who do not mow grass.
