COUNCIL PROCEEDINGS
November 9, 2015

The Oelwein City Council met in regular session Monday, November 9, 2015. Mayor Sherrets called the meeting to order at 5:00 P.M.

Roll Call PRESENT: Cantrell, B. Weber, Ryan, Stickel, Milks, M. Weber
ABSENT: None
ALSO PRESENT: Letzring, Rigdon, VanVeldhuizen

Adopt Agenda A motion was made by M. Weber, seconded by Ryan to adopt the agenda as amended. All voted aye.
Motion Carried

Holly Wolff Holly Wolff, 101 South Frederick Avenue questioned when the Public Hearing and council decision regarding the sale of 105 South Frederick be back on the agenda. City Attorney VanVeldhuizen replied hopefully on or before November 23, 2015 at the next special or regular council meeting.

Wolff requested notice be given to her and neighboring property owner at 109 South Frederick.

Consent Agenda A motion was made by Ryan, seconded by B. Weber to approve the following consent agenda items:
1. Approval of the minutes of the October 26, 2015 regular meeting.
2. New Class ‘E’ Liquor, Class ‘B’ Wine, Class ‘C’ Beer and Sunday Sales for Super Mart.
All voted aye.
Motion Carried

Public Hearing Mayor Sherrets opened the Public Hearing on proposed disposal by sale of the City’s interest in 136 4th Avenue SW, Oelwein, Fayette County, Iowa.

Roger Boleyn requests salvageable items be given to Habitat for Humanity. As the new owner Boleyn will have full rights to the property.

A motion was made by Ryan, seconded by Stickel to close the hearing. All voted aye.

Resolution #4854 A motion was made by B. Weber, seconded by Milks to adopt Resolution No. 4854 Directing the Sale of the City’s Interest in 136 4th Avenue SW, Oelwein, Fayette County, Iowa.

Ayes: Cantrell, B. Weber, Ryan, Stickel, Milks, M. Weber
Nays: None
Motion Carried

Donaldson’s Bldg. Attorney VanVeldhuizen stated 4,000 sq. ft. of the former Donaldson’s building is not in use and Doug Bryan would like to lease that space for 12 months.

Resolution #4855 A motion was made by Cantrell, seconded by Stickel to adopt Resolution No. 4855 Authorizing the Mayor to Execute Lease on Former Donaldson Building.

Resolution #4856 A motion was made by B. Weber, seconded by Milks to adopt Resolution No. 4856 Providing for Reduction of Interest Rate for Taxable Sewer Revenue Bond.

Edgewater Estates Attorney VanVeldhuizen gave a brief synopsis regarding Plan and Plat of Edgewater Estates. Even though this is outside city limits the City needs to approve a subdivision within two miles of city limits. Chris and Josh Black are property owners who are subdividing what was known as Edgewater Golf Course in 19 residential lots. Each of 2 lots will have a shared driveway, shared sanitary sewer, and a shared well. There will be no city sewer or water, nor rural water to the subdivision. The Blacks have met all of the restrictive covenants the city requires. Oelwein Planning and Zoning met Monday and approved the plat the subdivision.

Resolution #4857 A motion was made by Stickel, seconded by Cantrell to adopt Resolution No. 4857 Accepting and Approving the Plan and Plat Known as Edgewater Estates, Fayette County, Iowa.

Valones Mayor encourages everyone to stop by the new downtown restaurant Valones.

Underground Storage VanVeldhuizen reported Fayette County Board of Supervisors approved removal of underground storage tanks, approved abating all the taxes against the property and approved conveying the property to the City of Oelwein regarding 956 South Frederick.

122 1st Street SW VanVeldhuizen reported that more than just the collapsed portion of 122 1st Street SW structure needs to be demolished. He feels all of the building along the frontage of 1st Street needs to be removed. Additional asbestos testing will need to be completed.

Adjourn A motion was made by M. Weber, seconded by Ryan to adjourn at 5:18 P.M. All voted aye.
