May 22, 2017

The Oelwein City Council met in regular session Monday, May 22, 2017. Mayor Sherrets called the meeting to order at 6:00 P.M.

Roll Call PRESENT: M. Weber, Cantrell, B. Weber, Christensen, Stickel, Milks
ABSENT: None
ALSO PRESENT: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by M. Weber, seconded by Christensen Stickel to adopt the Agenda as presented. All voted aye.

Proclamation Mayor Sherrets presented a proclamation to Miss Poppy Holly Rose Rubin and
Poppy Days Poppy Chair Mary Lou Kimball proclaiming May 25-27, 2017 as Poppy Days.

Jennifer Choate Jennifer Choate, 20 3rd Avenue NE requested a variance to an ordinance that would allow her wedding party (10 people) to ride in a pickup truck from Sacred Heart Church to Knights of Columbus on July 1, 2017 at 2:00 P.M. This request is listed on the Consent Agenda Item L.

Ryan DeHaven Ryan DeHaven, Hub City Power Sports requested bidding guidelines for city purchases from Park and Cemetery Departments so bids can be compared equally. His bid for a Pro Turn Mower cost is less than a competitors bid for a ZTrak, but his bid is not being approved. Council requests consent agenda item D not be approved tonight and relist the bids for next council meeting.

Consent Agenda A motion was made by Stickel, seconded by Cantrell to approve the following Consent Agenda Items:

a. Minutes of the May 8, 2017 regular Council Meeting
b. Claims Resolution in the amount of $196,656.35
c. Motion approving purchase of Offset Flail Mower in the amount of $7,399 from Iowa Farm Equipment for Street Department
d. Motion approving the purchase of Treadmill in the amount of $5,520.00 from Push-Pedal-Pull for Williams Wellness Center
e. Motion authorizing Mayor to sign an agreement for electronic transactions between the City of Oelwein and USDA
f. Motion authorizing signatures on Certificate of Substantial Completion with CJ Moyna & Sons, Inc. for Oelwein Industrial Park 3rd Addition Public Improvements Plan
g. Motion authorizing signatures on Certificate of Substantial Completion for Charles Street Water Main Improvements
h. Motion authorizing Pay Application 1 for Charles Street Water Main Improvements: $115,494.54
i. Request to reschedule Oelwein Food & Fitness Fun Run for Saturday, June 17, 2017
j. Motion acknowledging changes for Farm Lease
k. Motion allowing for variance of Oelwein Municipal Code Section 22-13, Clinging to Vehicles

Consent Agenda Item D to purchase a Ztrak Mower for the Cemetery was tabled and will be relisted on the next agenda.

Cantrell questioned if Item J, Oelwein Food and Fitness Fun Run had gotten their liability insurance coverage.

Budget Amendment No. 4976 Approving 2016-2017 Budget Amendment.

Utility Rate A motion was made by B. Weber, seconded by Cantrell to adopt the second
2nd Reading reading of an Ordinance re: Utility Rates.

Resolution #4977 A motion was made by B. Weber, seconded by Cantrell to adopt Resolution
Fee Schedule No. 4977 Approving the Oelwein Fee Schedule.

Mulfinger stated the new fee schedule rates are effective May 23, 2017.

Resolution #4978 A motion was made by M. Weber, seconded by Cantrell to adopt Resolution
Set Hearing – Hotel No. 4978 to fix a date of meeting at which it is proposed to hold a hearing on
Property a Development Agreement with Boulders Inn Oelwein, LLC, including the sale of city-owned real property.

Set Hearing – Portion A motion was made by M. Weber, seconded by Cantrell to Set a Public
Occo Drive Hearing for the Vacating and Disposal of the Eastern Portion of Occo Drive for 5:30 P.M. May 30, 2017. All voted aye.

Airport Meeting Stickel reported on the May Airport Board meeting. The Board is working on Hangar Rules and Regulations.

Park & Rec Mtg. Cantrell reported on the May Par & Recreation Commission meeting. The Tree Board discussed Emerald Ash Bore and are reviewing the list of approved trees for the city. United Way Day of Caring volunteers planted 40 trees, painted city park bathroom, and picked sticks and debris in parks, along trails and downtown. Fayette Appreciation Day volunteers painted playground equipment. Prairie planting at Redgate Park, flower planting at the Aquatics Center, Diamond 1 improvements city lake cleanup, and campground improvements are some of the many changes in Oelwein parks. Park events can be followed on City of Oelwein Facebook Page. You can volunteer by contacting Park Superintendent Josh Johnson at Oelwein City Hall.

Frisbee Golf sponsors are still needed to sponsor a hole with their name or advertisement.

Fireworks Mayor Sherrets requested a work session be scheduled discussing rules and regulations regarding fireworks within the city limits.

Council Recordings Mulfinger shared his ideas for new recording equipment for council meetings costing approximately $4,000. Council consensus was to move forward.

City wide spring cleanup was a success. A discussion regarding setting up rules to follow for the next cleanup should be reviewed.

Executive Session A motion was made by B. Weber, seconded by Milks to go into Executive Session per Iowa Code 21.5(1)(i) to evaluate professional competency of individuals whose appointment, hiring, performance or discharge is being considered when necessary to prevent needless and irreparable injury to the individual’s reputation and at the request of said individual.

Employment A motion was made by B. Weber, seconded by Cantrell to provide a five percent
Agreement raise effective May 23, 2017 for the City Administrator based on performance review. Effective salary is $88,200.00. All voted aye.

Executive Session A motion was made by M. Weber, seconded by B. Weber to go into Executive Session per Iowa Code 21.5 (1)(c) to discuss strategy with Counsel in matters that are presently in litigation where disclosure would be likely to prejudice or disadvantage the position of the City in that litigation.
