October 9, 2017

The Oelwein City Council met in regular session Monday, October 9, 2017. Mayor Sherrets called the meeting to order at 6:00 P.M.

Roll Call PRESENT: B. Weber, Christensen, Stickel, Milks, M. Weber, Cantrell
ABSENT: None
ALSO PRESENT: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by M. Weber, seconded by Stickel to adopt the Agenda as presented. All voted aye.

Consent Agenda A motion was made by Stickel, seconded by Cantrell to approve the following Consent Agenda items:

A. Motion approving September 25, 2017 regular council minutes

All voted aye.

Public Hearing on A motion was made by Milks, seconded by B. Weber to open the Public
Sale of 1104 Hearing on the proposed sale of city property located at 1104 West
West Charles Charles.

Jay Woodward, 12 11th Avenue SW stated he is not against selling the property but is against building a four-plex on the property. He stated it is too small, there will be no yard and where will all their cars park. He was speaking on behalf of several other adjacent property owners. They were concerned the new renters would not be good renters, as in the past because there is too much government funded housing in this community. Their neighborhood was now peaceful since the police no longer need to respond to those issues.

Stickel said a new building would look good in that area. B. Weber too agreed that the parking may be an issue.

Deb Howard, OCAD Director, spoke on behalf of the developer and he wants to build multiple developments in town. He is very conscientious of what he would want if he lived in that neighborhood.

It was council consensus to meet with the developer to gather more information before making a decision.

A motion was made by B. Weber, seconded by Cantrell to close the public hearing.

Table Sale of 1104 A motion was made by M. Weber, seconded by Milks to table the sale
West Charles of 1104 West Charles until more information is presented.

Resolution #4998 A motion was made by M. Weber, seconded by B. Weber to adopt
Internal loan from Resolution No. 4998 Approving Internal Loan and Obligating funds
Water Payment to from the East Penn Subfund of the City’s Industrial Park Urban
Series 2016 Notes Renewal Tax Revenue Fund for appropriation to the payment of General Obligation Bonds and Bond Anticipation Notes, Series 2016.

Resolution #4999 A motion was made by Milks, seconded by Cantrell to adopt
GO 2016C Early Resolution No. 4999 Providing for early redemption of outstanding
Redemption principal balance of Annual Appropriation General Obligation Bond Anticipation Note, Series 2016C.

Resolution 5000-2017 A motion was made by B. Weber, seconded by Cantrell to adopt
DOT Agreement Resolution No. 5000-2017 to Authorize Signature on Iowa Department
Old Road Paving of Transportation Federal-Aid Agreement for Surface Transportation
Improvements Program Project – Old Road Paving Improvements.

Resolution 5001-2017 A motion was made by Milks, seconded by Cantrell to adopt
Tree Policy Resolution No. 5001-2017 Oelwein Tree Policy.

Fencing Purchase A motion was made by M. Weber, seconded by Cantrell to approve purchase of fencing for ball diamond three in the amount of $7,176.00 from Ace Hardware using Northeast Iowa Charitable Grant Funds. All voted aye.

Purchase 2007 A motion was made by B. Weber, seconded by Stickel to approve purchase of
Johnston Street 2007 Johnston Street Sweeper from Truck Equipment, Inc. in the amount of
Sweeper $15,000.00. All voted aye.
Motion Carried

This upgrade would replace the 1999 Elgin Pelican and also have the ability to vacuum leaves.

Purchase Heloc A motion was made by Milks, seconded by Stickel to approve purchase of
Roto-Tilt & Ditching Heloc Roto-Tilt and Ditching Bucket from Murphy Tractor & Equipment
Bucket Co. in the amount of $8,588.00. 5 voted aye, 1 (M. Weber) voted nay.

This would be attached to the Street Department backhoe to allow the bucket to dig sideways in ditches and underneath water pipe lines. In the past, the city has had up to 40 broken water lines a year due to aging infrastructure that needed to be dug up and replaced.

Police Department A motion was made by M. Weber, seconded by B. Weber approving the
Network Server purchase and replacement of a server in an amount not to exceed $25,000 for the Police Department. All voted aye.
Motion Carried

This is not a budgeted item but due to failure of current unit it became a necessity.

Public Safety Mtg. A motion was made by B. Weber, seconded by Cantrell to approve Public Safety Committee recommendation and refer the following three topics to Council Work Session:

1. Traffic Planning
2. Chronic Nuisance Property
3. Vicious Dog

All voted aye.
Motion Carried

Planning, Finance, A motion was made by B. Weber, seconded by Milks to approve
Enterprise and Planning, Finance, Enterprise and Economic Development
Economic Develop Committee recommendation for demolition to demolish 205 7th Avenue SW for Becky Becker upon receipt of a second valid demolition quote in writing at 50% reimbursement to property owner not to exceed $3,750.00. All voted aye.
Motion Carried

City Attorney is working on a couple landowners on voluntary surrenders of nuisance property.
