Regular Meeting
June 11, 2018

The Oelwein City Council met in regular session Monday, June 11, 2018. Mayor Sherrets called the meeting to order at 6:00 P.M.

Roll Call PRESENT: Derifield, Fisk, Christensen, Milks
ABSENT: Weber, Cantrell
ALSO PRESENT: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Milks, seconded by Derifield to adopt the agenda as amended. All voted aye.
Motion Carried

Paul Ganske Paul Ganske, 116 Eastline Road informed council of a dilapidated garage building at 116 5th Avenue NE.

Consent Agenda A motion was made by Fisk, seconded by Christensen to adopt the Consent Agenda as follows:
A. Motion approving May 29, 2018 regular council minutes.
B. Motion to set Schott vicious animal appeal for June 25, 2018 at 5:00 P.M.
C. Class ‘C’ Liquor, Outdoor and Sunday Sales renewal for Von Tuck’s Bier Haus dba Dave’s Place
D. Pay Request No. 3 to Flynn Company in the amount of $172,657.87 for work completed on Old Road Paving Improvements Project.
All voted aye.

Ordinance 1162 A motion was made by Christensen, seconded by Milks to adopt Ordinance
Amend Code Ch. 22 No. 1162 Amending Code Section 22-90, Section 22-94, Section 22-104, Section 22-105 and adding Section 22-106 to Modify Parking Positions, Parking Areas Generally, Fines and Failure to Pay and Adding Impoundment of Vehicles for Unpaid Fines or Repeated Violations on the third and final reading.
Ayes: Derifield, Fisk, Christensen, Milks
Nays: None

1st Reading Ch. 19 A motion was made by Fisk, seconded by Milks to adopt the first reading
Animal & Fowl of an Ordinance Amending Oelwein Code of Ordinances Chapter 19 Animal and Fowl.

Resolution 5039-2018 A motion was made by Derifield, seconded by Christensen to adopt
28E Agreement Resolution No. 5039-2018 in support of the Law Enforcement Services in and
Mutual Aid around the northeast Iowa area and specifically the counties of Allamakee, Bremer, Buchanan, Chickasaw, Clayton, Delaware, Fayette and Winneshiek and the cities of Decorah, Dyersville, Fayette, Independence, Manchester, New Hampton, Oelwein, Waukon, Waverly, West Union and all cities within the above listed counties 28E Agreement for Mutual Assistance.

Resolution 5040-2018 A motion was made by Fisk, seconded by Milks to adopt Resolution
Multi Hazard No. 5040-2018 Adopting Fayette County, Iowa Multi-Jurisdiction
Mitigation Plan (MJ-14) Multi-Hazard Mitigation Plan.

Adopt Mission A motion was made by Christensen, seconded by Derifield to table a
Statement Goals Resolution Adopting a Mission Statement, Values, and Goals for the City of Oelwein to be relisted at next meeting when full council will be present. All voted aye.

Resolution 5041-2018 A motion was made by Milks, seconded by Fisk to adopt Resolution
Salaries 2018-2019 No. 5041-2018 establishing salaries for Fiscal Year 2019-8-2019.

Appointment A motion was made by Milks, seconded by Fisk to approve the appointment
Plaza Board of Andrew Miller to the Community Plaza Board of Governors. All voted aye.

City Attorney City Attorney Dillon reported on several nuisance properties.

Safety Cameras Milks requested traffic camera ordinance be discussed and relisted on the agenda. Milks referenced the Letter to the Editor in Oelwein Register thanking Police Department for putting the speed trailer out to slow down traffic. At her business, Lou Ann’s Quilt Shop people from out of town to shop at her business. She did a two day poll asking them if they knew Oelwein had speed cameras would that deter them from coming to Oelwein. Everyone said no – because they didn’t speed. Customers asked were from surrounding town including Westgate, Independence, Waterloo, Sumner, Fairbank and Cedar Falls. Also asked were customers from Minnesota, Oklahoma and South Carolina.

On Wednesday, June 6th she observed a vehicle running a red light. “Council needs to stand behind the Police Department in support of safety cameras, if we don’t we are failing to do our duty” stated Milks. Who is afraid of or why they are afraid of speed cameras. It is a safety issue.

Christensen stated he will talk to other local business owners in town.

A work session will be set for more discussion on safety cameras.
