Regular Meeting
October 22, 2018

The Oelwein City Council met in regular session Monday, October 22, 2018 at 6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Derifield, Fisk, Christensen, Milks, Weber, Cantrell
Absent: None
Also Present: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Milks, seconded by Derifield to adopt the agenda as amended. All voted aye.
Motion Carried

Wellmark Grant Becky Bland from the Wellmark Foundation presented Joshua Johnson, Park and Recreation Supervisor a $87,353 check for trail improvements.

Ben Driscoll Ben Driscoll, 118 2nd Street NE, confirmed the work session with Hub City Landlords was November 13, 2018 following the regular council meeting.

Consent Agenda A motion was made by Weber, seconded by Cantrell to adopt the Consent Agenda as follows:

A. Motion approving October 8, 2018 regular council minutes.
B. Claims Resolution in the amount of $518,341.61.
C. Pay Request No. 6 to Portzen Construction in the amount of $70,841.50 for work completed on Disinfection and 42 Well Improvements Project.

All voted aye.

Public Hearing A motion was made by Milks, seconded by Christensen to open the Public
Disposal of City Hearing on the proposed disposal by sale of city owned property described
Property as Lot 16, Block 9, Oelwein Land Company’s First Addition to Oelwein, Fayette County, Iowa.

Fisk questioned why the lot was being sold for $500.00 when it had a value of $7,000 on Beacon. Mulfinger stated if it’s included in a larger project or nonconforming it can be sold to neighboring property owners so the city doesn’t have the expense of mowing it. It is not a buildable lot and the neighboring property owner needs it to improve the foundation and drainage since the property slopes 2 feet back into the house. Ron Winter explained the details to council.

Mulfinger offered to review the lot sale policy if council deemed necessary.

Resolution 5055-2018 A motion was made by Weber, seconded by Milks to adopt Resolution
Sale of City Property No. 5055-2018 Directing the Sale of the City’s Interest in Lot 16, Block 9, Oelwein Land Company’s First Addition to Oelwein, Fayette County, Iowa.

Ordinance 1166 A motion was made by Weber, seconded by Milks to adopt Ordinance No. 1166
Vacant Bldg Permit Adding Article IX, Section 12-400 through Section 12-411 Vacant Building Permit and Inspection on the third and final reading.

Ordinance 1169 A motion was made by Weber, seconded by Fisk to adopt Ordinance No. 1169
Landfill Rate Amending Section 16-40 Landfill Rate Classification; Charges and County Recycling Program Fund on the third and final reading.

Resolution 5056-2018 A motion was made by Milks, seconded by Derifield to adopt Resolution
Set Hrg-Vacate Alley No. 5056-2018 to set Public Hearing on Proposed Vacation of that Portion of the Alley Running North and South in Block 12, Armstrong’s Addition to Oelwein, Fayette County, Iowa on November 13, 2018 at 6:00 P.M. All voted aye.

Resolution 5057-2018 A motion was made by Milks, seconded by Cantrell to adopt Resolution
Set Hrg-Sell Alley No. 5057-2018 to set Public Hearing on Proposed Disposal by Sale of the City’s Interest in that portion of the Alley Running North and South in Block 12, Armstrong’s Addition to Oelwein, Fayette County, Iowa on November 13, 2018 at 6:00 P.M.

Ayes: Derifield, Christensen, Milks, Weber, Cantrell
Nays: None

Resolution 5058-2018 A motion was made by Milks, seconded by Weber to adopt Resolution
Rental Housing Policy No. 5058-2018 formally adopting the Oelwein Rental Housing Inspection Administrative Policy.

Resolution 5059-2018 A motion was made by Milks, seconded by Christensen to adopt
Rental & Vacant Resolution 5059-2018 Amending the Oelwein Fee Schedule to Include Rental
Bldg. Permit Fees Inspection Fees and Vacant Building Permit Fees.

Cantrell questioned if the city received any bids for the company to do the first round of inspections. None were received. She also inquired if there would be enough funds to pay for hiring of a Building Official and Administrative Assistant. Mulfinger stated a safe estimate based on 800 rentals should pay for program costs and salaries with a subsidy from Franchise Fees in the beginning.

Fisk questioned when fees would be paid. Mulfinger stated the landlord pays fees when they register January 2019. The fees will be added to the cities regular fee schedule with an annual review in December.

Fox Engr. Task Order A motion was made by Weber, seconded by Derifield to authorize
Wings East Addition signatures on Fox Engineers Task Order No. 1022-18A in the amount of $28,500 for Wings East Addition. All voted aye.

Trails Crack Sealing A motion was made by Cantrell, seconded by Milks authorizing crack sealing to walking trails in the amount of $6,393.08 by Kluesner Construction.

Airport Board Meeting Derifield reported on the October Airport Board meeting. Budget items were reviewed. FBO Tegeler is interested in the old lift and he’d work to repair it.

Park & Recreation Cantrell reported on the October Park and Recreation Commission meeting.
Commission Mtg. Ashland Taylor is a newly appointed board member. New water fountains were installed in Wings and City Park with hopes of a new fountain for Platts Park if funds become available or are donated.

Library Board Meeting Christensen reported on the October Library Board meeting. Discussion on installing an electric car charging point took place. Friends donated $1,000 towards special events and $1,000 to purchase DVD’s. New officers were elected with Dee Gerstenberger and Pat Taylor as new board members.

City Attorney City Attorney is working on two nuisance properties to get cleaned up.

New Business Cantrell informed council the Buchanan County Animal Shelter has
Buchanan Co. Animal opened and encouraged them to tour the facility.

Code Enforcement Fisk expressed his concerns regarding what gets enforced and lightly gets enforced. City code is over 500 pages of ordinances to enforce how can the city accomplish all that plus the new rental code. Sherrets inquired if there was something in particular Fisk wanted to discuss. He stated a camper has been parked in an area it should not be with people living in it on and off. Code stated 14 continuous days living in a camper needs to be registered at City Hall. High priority code enforcement items get addressed but officers still took time to stop by the property owners regarding the camper.
