Regular Meeting
November 13, 2018

The Oelwein City Council met in regular session Monday, November 13, 2018 at 6:00 P.M. Mayor Sherrets presided.

Roll Call Present: Derifield, Fisk, Christensen, Milks, Weber, Cantrell
Absent: None
Also Present: Mulfinger, Rigdon, Dillon

Adopt Agenda A motion was made by Weber, seconded by Christensen to adopt the agenda as presented. All voted aye.
Motion Carried

Ginger O’Connell Ginger O’Connell, 303 3rd Street NE referenced a newspaper article in the Oelwein Register regarding a municipal infraction where both parties failed to appear in court. City Attorney Pat Dillon stated compliance had been met and the case would be dismissed. Then she reported the open air carport is still standing. If current codes weren’t enforced what can be expect from rental codes.

Consent Agenda A motion was made by Fisk, seconded by Weber to adopt the Consent Agenda as follows:

A. Motion approving October 22, 2018 regular council minutes.
B. Class ‘B’ Beer Permit Renewal for Oelwein Chamber and Area Development

All voted aye.
Motion Carried

Debt Report Maggie Burger, Speer Financial presented the cities TIF and Debt report to council also explaining the cities debt capacity.

Urban Renewal Report A motion was made by Fisk, seconded by Cantrell to approve the Urban Renewal Report re: F.Y. 2017-2018 TIF Debt Outstanding. All voted aye.

Public Hearing A motion was made by Derifield, seconded by Milks to open the Public Hearing
Portion of Alley on Proposed Vacation of that Portion of the Alley Running North and South in
Block 12, Armstrong’s Block 12, Armstrong’s Addition to Oelwein, Fayette County, Iowa.

Ayes: Fisk, Christensen, Milks, Weber, Cantrell, Derifield
Nays: None
Motion Carried

Mulfinger stated council can discuss price prior to sale and create a policy.

A motion was made by Weber, seconded by Derifield to close the hearing.

Vacate Alley – 1st A motion was made by Weber, seconded by Milks to adopt the first
Reading reading of an Ordinance Providing for the Vacation of that Portion of the Alley Running North and South in Block 12, Between Lots 1-6 and 7-12, Armstrong’s Addition to Oelwein, Fayette County, Iowa.

Ayes: Christensen, Milks, Weber, Cantrell, Derifield
Nays: None
Abstain: Fisk
Motion Carried
Public Hearing A motion was made by Weber, seconded by Milks to open the Public Hearing on
Proposed Disposal of Proposed Disposal by Sale of the City’s Interest in that Portion of the Alley
Alley Running North and South in Block 12, Armstrong’s Addition to Oelwein, Fayette County, Iowa.

Ayes: Christensen, Milks, Weber, Cantrell, Derifield
Nays: None
Abstain: Fisk

Close Hearing A motion was made by Weber, seconded by Cantrell to close the hearing.

Resol. # 5060-2018 A motion was made by Fisk, seconded by Cantrell to adopt Resolution No. 5060-
Easements ITC 2018 authorizing signatures on Easements with ITC Midwest LLC for Vegetation
Midwest Management.

Ayes: Fisk, Christensen, Milks, Weber, Cantrell, Derifield
Nays: None
Motion Carried

Parkview Addition A motion was made by Weber, seconded by Christensen to approve Parkview
Preliminary Plat Addition Preliminary Plat. All voted aye.
Motion Carried

Rezoning Request A motion was made by Christensen, seconded by Fisk to forward to Planning
Matt Stickfort and Zoning Commission for review and recommendation a request from Matt Stickfort to rezone Lots 3-7, Block 6, Miles Addition and N 10’ alley adjoining on South from R-2 Residential to C-2 Commercial to allow for storage units. All voted aye.
Motion Carried

Weber wondered what is the current capacity of storage unity already occupied. Do we need more? Christensen stated Matt Stickfort said his units are full. Fisk and Sherrets thought it was a good location.

Engineer West Water A motion was made by Cantrell, seconded by Derifield to approve the City
Tower Administrator’s recommendation for West Water Tower project engineer to Fox Engineering. All voted aye.
Motion Carried

Recommendation was based on ranking criteria completed by Utility Superintendent, City Administrator and Deputy Clerk.

Reappointment to A motion was made by Cantrell, seconded by Fisk to approve the reappointment
Civil Service and of Elmer Pearson to the Civil Service Commission and Ken Woodraska and
Airport Board Tommy Nations to the Airport Board. All voted aye.

City Attorney Report City Attorney stated he has been engaged with the Department of Transportation how the city views speed limits vs. DOT’s interpretation. He is also working on nuisance properties through the court system.

Adjourn A motion was made by Milks, seconded by Weber to adjourn at 6:40 P.M. All voted aye.

A work session with Aaron Olson, TP Anderson on 2018 Fiscal Year Annual Audit preceded the regular council meeting. A work session with Oelwein landlords followed the regular meeting.
